Parliamentary scrutiny needed for 'trans bathroom ban' updated EHRC Code of Practice

In April 2025, the UK Supreme Court ruled on the definition of 'sex' in the Equality Act 2010. The ruling stated 'sex' refers to biological sex, meaning a person's sex as recorded at birth. In doing so, they overturned 15 years of legal understanding. 

The Equality and Human Rights Commission (EHRC) has now submitted an updated statutory Code of Practice on Services, Public Functions and Associations (also commonly known as the 'trans bathroom ban' to Bridget Philipson, Education Secretary & Minister for Women & Equalities.

This new Code impacts the fundamental rights of both trans and non-trans people in the UK. This comes after a relentless year of challenges and dehumanising actions taken against trans+ folks and their rights, which continue to be intensely scrutinised, reduced and stripped back. 

This Code could mark one of the most significant changes to equality law since 2010, and needs to be challenged and reviewed in Parliament.

That's why we are asking our supporters to take action for trans+ rights, by writing to their local MP by Monday 8th December.
